However, some covered entities are exempt from developing this notice. These include healthcare clearinghouses operating solely as business associates of other covered entities, correctional institutions that are covered entities, and group health plans providing benefits solely through insurance contracts, without handling other protected health information.

Content of the Notice
Covered entities are obligated to furnish a notice written in plain language that delineates:

      -  How the covered entity might use and disclose protected health information about an individual.
      -  The individual's rights concerning this information and how they can exercise these rights, including the process for raising complaints.
      -  The covered entity's legal obligations concerning this information, including a statement underscoring its legal duty to safeguard protected health information.
      -  Contact information for individuals to inquire further about the covered entity's privacy policies.
      -  An effective date for the notice.

In cases of significant changes to privacy practices, covered entities must promptly revise and circulate the notice. Health plans must provide the notice to both current and new enrollees, while covered direct treatment providers must supply the notice at the time of the first service delivery. For electronic services, providers must send the notice upon the individual's initial request for service.

Providing the Notice
The notice must be accessible to anyone requesting it. Covered entities should prominently post the notice on any websites providing information about their services. Health plans are required to distribute the notice to their enrollees, and covered direct treatment providers must give the notice to individuals during their initial service delivery. Additionally, the notice should be made available for individuals to take with them and displayed prominently at the provider's facility.

Organizational Options
Covered entities, including hybrid or affiliated entities, may choose to create multiple notices, particularly if they perform various covered functions with differing privacy practices. Joint notices are also permissible if the requirements are met, allowing multiple entities to share a single notice.
